These terms and conditions between the Collector (“you”, “your”) and Loyalty Management UK Limited of 3rd Floor, 80 Strand, London WC2R 0NN (“Nectar”, “we”) apply to purchases of the products available for sale under Nectar to Your Door (“the Products”). Nectar’s Policy on Privacy and Data Protection shall continue to apply.
Place your order online at www.nectar.com or call the Nectar Rewards Hotline on 0870 4 100 250. Quote Product(s) you wish to order, and your Nectar card number and credit/debit card details if applicable. We can only accept the following cards : Maestro, Delta, Visa, Mastercard and American Express as payment. All orders are subject to these terms and conditions (“Product Conditions”). You must be over 18 to place an order for the Products. These Products are only available for the stated number of points or points plus cash.
Products are available to order until 30th September 2008. Products are subject to availability. We reserve the right to substitute the Products with products of a similar specification of the same or better quality at the same price. We shall endeavour to advise you of any substitutions when you place your order. If you are not happy with the replacement you can return it in accordance with clauses 11-13. In the event that we are unable to supply the Products, we will inform you of this as soon as possible. A full refund will be given where you have already paid for the Products.
The Products can only be delivered to the address specified by the Primary Collector, provided that the address is on the UK mainland, Northern Ireland, Channel Islands, Isle of Man and the Scottish Islands. All Products must be signed for by an adult aged 18 years or over on delivery. All prices include delivery. We aim to deliver all products within 10 working days from the date of order. Orders received after the 15th December in any year may not be delivered in time for Christmas. If you order more than one Product they may be delivered separately.
Risk of loss and damage of Products passes to you on the date when the Products are delivered and signed for.
We take payment from your credit/debit card at the time we take your order and deduct the relevant number of Nectar points from your account overnight. If you have insufficient Nectar points at that time we will cancel your order and will also credit any payment made via your credit/debit card.
Title to any Products you order shall pass to you on delivery of the Products provided that we have processed and received payment in full for the Products.
Points required and prices indicated are subject to confirmation when you place your order. All Products include VAT (where applicable) at the applicable current rates.
Nothing in these Product Conditions affects your statutory rights (including those to cancel the contract) or excludes or limits any negligence, fraudulent misrepresentation or other liability to the extent it cannot be excluded or limited by law. Subject to this, your only rights will be those expressly set out in these Product Conditions. To the extent we are permitted by law to limit any liability to you, that liability shall be limited to the price of the relevant Products.
We shall give information about you to third parties in order to fulfil Nectar’s agreement with you, including delivery of the Products, and where applicable, their return.
If you are not happy with your purchase for any reason and wish to cancel your agreement with Nectar, you have 7 days from the day after the date of your delivery to advise us. Cancellations will not be accepted after that time.
Call the dedicated returns number that appears on your delivery note and quote your order number.
We shall then arrange for collection of the Product(s) free of charge. Refunds for points and credit/debit cards will only be processed upon receipt of the Product(s) and may take up to 21 working days from receipt. Products must be returned unused and in their original packaging, together with the order details as enclosed with the Product(s) on delivery to you.
