FULL TERMS AND CONDITIONS

Section 1:

  1. This promotion is open to UK residents only (except where the prize relates to alcohol in which case Scotland and Northern Ireland are excluded) aged 18 and over who hold a Nectar Card, with the exception of employees of Unilever UK Limited, Lever House, 3 St James Road, Kingston Upon Thames, United Kingdom, KT1 2BA Nectar 360 Limited of Holborn, London, EC1N 2HT (“Promoter”), Nectar (as defined below), and/or or anyone professionally connected with this Promotion. The Winner (as defined below) must have a valid passport, valid travel and medical insurance, and have authority to enter the USA in order to be awarded the Prize (as defined below).

  1. The promotion opens at 00:00 on 28/05/2025 and closes at 23:59 on 08/07/2025 for receipt of all entries.
  2. Online and in store selected stores only, excludes Locals. All online orders if applicable must be delivered by 23:59 on 08/07/2025] to qualify.
  3. Entries are restricted to one per person for the duration of the promotion. No entries from agents, third parties or organised groups will be accepted. No bulk entries.
  4. There is one (1) prize only for one (1) winner only which comprises the following:
  • 2x return economy flights (from London to Los Angeles) - flight out and return to be confirmed by the Promoter at a later date;
  • 7-nights’ accommodation in a 4 star hotel - that is 1 room with double occupancy; - check-in and check-out dates and times will vary depending on the tickets received;
  • Private transfer (from and to the applicable Los Angeles airport only); and

(the flights, the accommodation and the private transfer referred to collectively as the “Trip”)

  • GBP £1,500 (one thousand five hundred British Pounds Sterling) to spend during the Trip and on the following only: (i) breakfasts; (ii) lunches; (iii) dinners; (iv) intra-city Los Angles transport; and (v) transfers to and from the applicable UK airport (“Spending Money”).

(the Trip and the Spending Money referred to collectively as the “Prize”).

  1. The winner of the Prize (“Winner”) will be drawn at random by Nectar during the week commencing two (2) weeks following the promotion end date under independent supervision. If you do not wish to receive the Prize please contact Nectar on 0344 811 0811.
  2. The Promoter’s decision is final and binding in all matters and no correspondence will be entered into. Where the promotion is run via social media including but not limited to Instagram, Facebook and Tik Tok then the promotion is no way affiliated with such social media platforms.
  3. The Winner will be notified by Nectar either telephone or email or social media direct message so therefore entrants will have needed to have supplied valid contact details. Winner will be contacted by Nectar within twenty-eight (28) days of the closing date.
  4. If the Winner does not respond when contacted on two (2) separate occasions, the Prize will be forfeited and a back-up Winner will be chosen by Nectar and notified by telephone.
  5. The Promoter and Nectar reserves the right to withdraw Prize entitlement where there are reasonable grounds to believe there has been a breach of these Terms and Conditions.

 

SECTION 2:

By entering this promotion you acknowledge, agree and understand that in the event you are the Winner:

  1. all components of the Prize must be claimed by you at the same time;
  2. you will be contacted by Umbrella Risk Management Limited (acting on behalf of the promoter), with registered office address Dodwell House, Chilton Business Centre, Chilton Buckinghamshire, HP18 9LS (“Umbrella”) to arrange the necessary travel arrangements and otherwise to fulfil the Prize;
  3. you will be fully responsible, including legally responsible, for your chosen guest (“Guest”) at all times.
  4. your Guest can be under the age of 18 provided that:
  5. . This is to comply with all applicable laws, regulations and codes of practice regarding the Guest traveling without their parent or guardian;
  6.  
    1. both you and the Guest:
  7. must have: (i) a valid passport with a minimum of 6 months’ validity from the date of travel; and (ii) a visa, ESTA and/or any other applicable documentation required by the USA confirming that both you and the Guest’s authority to travel to the USA;
  8. must have valid, adequate and sufficient travel and medical insurance for your period of travel and duration of your stay in the USA and both you and the Guest are fully responsible for the cost and expense of obtaining such insurance;
  9. must travel together, including travelling on the same flights and staying in the same accommodation;
  10. are fully responsible for any and all taxes, and for any other fees or costs associated with the Prize received, regardless of whether it, in whole or in part, is used;
    1. you and the Guest are responsible for the visa, ESTA (and/or other applicable documentation) application process, issuance and/or use, which is solely under the control of the government of the USA. Any costs or expenses associated with such application is the sole responsibility of you and the Guest and will not be reimbursed by the Promoter or Nectar;
    2. if a visa, ESTA and/or any other applicable documentation required by the USA required for entry into the USA, Umbrella will provide accommodation data needed for such application;
    3. if you do not provide Umbrella with a copy of the documents set out in paragraphs 4 and 5 of this Section 2 within twelve (12) weeks of the date you are notified that you are the Winner, the Prize will be forfeited and a back-up winner will be chosen by Nectar and notified by telephone;
    4. it is your and the Guest’s responsibility to organise transport to and from the UK departure airport (and to pay for the same using the Spending Money);
    5. frequent flyer points (or such other travel points) will not form part of the Prize;
    6. flights schedules are subject to change without notice. Neither the Promoter nor Nectar is liable for any missed events, opportunities, costs or expenses resulting from any travel related cancellations or delays;
    7. If you and/or the Guest miss any flights, transfers or fail to meet any check in requirements for any reason, no compensation or alternative travel arrangements will be provided. All associated costs and expenses will be your and the Guest’s sole responsibility;
    8. a debit or credit card may be required from you at check-in to the hotel for all incidental charges;
    9. unless expressly stated in these Terms and Conditions to be expenses which form part of the Prize, any and all costs and expenses incurred by you and/or the Guest in connection with the Trip to Los Angeles USA will be your and the Guest’s sole responsibility.
    10. all travel dates are set by the Promoter and must take place between 16th September 2025 and 1st August 2026 excluding:
  1. 12th December 2025 to 6th January 2026; and
  2. 26th March 2026 to 10th April 2026
    1. (subject to paragraph 8 of this Section 2) you must submit three (3) preferred dates of travel to Umbrella within twelve (12) weeks of being notified that you have won the promotion:
      1. all of which are no less than six (6) weeks’ prior to the requested date of travel; and
      2. which fall within the timeframe specified paragraph 16 of this Section 2;
    2. all requested travel dates submitted by you in accordance with paragraphs 15 and 16 of this Section 2 are strictly subject to availability; and
    3. once travel bookings are made:
  1. details (including without limitation dates and names) cannot be changed without incurring administration or cancellation fees from travel related companies (including without limitation airlines, hotels, transportation) and payment of such fees will be your and the Guest’s sole responsibility; and
  2. the Prize cannot be supplemented.
    1. (subject paragraphs 8, 15, 16 and 17 of this Section 2) you will receive an email from [INSERT] within a reasonable time prior to your date of travel which contains a secure link to facilitate payment of the Spending Money to you; (ii) you must click this link and submit accurate bank details to receive the Spending Money within thirty (30) days of the date of your submission; and (iii) accuracy is crucial to avoid delays or errors in processing the payment.

 

Section 3:

1.        Nectar is an independent controller (Independent Controller A) responsible for the personal data processing necessary to operate the Prize draw (e.g. collating entries, picking and notifying the Winner, review of transaction data to collate entrants, application of eligibility requirements, randomly allocating the Winner from entrants and subsequent notification) and shall be primary contact for data subjects and the Information Commissioner’s Office. For more information, including about your privacy rights, please refer to Nectar’s privacy notice (https://www.nectar.com/about/privacy-and-legal/privacy-policy).

For the purposes of fulfilment of Prize other than Nectar points, the Promoter is an independent controller (Independent Controller B) and, following the Winner’s acceptance of the Prize, the Promoter (and any agent appointed by the Promoter to assist with the fulfilment of the Prize) will process such personal data given to the Promoter by the Winner or by Nectar in accordance with the Promoter’s privacy policy available at https://www.unilevernotices.com/privacy-notices/united-kingdom-english.html.

Any personal data relating to entrants will be processed solely for the purposes of administering this Promotion and fulfilment of the Prize and/or by the Independent Controllers and/or any agent appointed by either of them to assist with running the Promotion and will not be disclosed to any other third party for any other purpose without prior consent.  Entrants’ personal data will be processed in accordance with the Independent Controllers’ privacy policy, available at: https://www.nectar.com/about/privacy-and-legal/privacy-policy and https://www.unilevernotices.com/privacy-notices/united-kingdom-english.html. 2.    The Promoter is not responsible or liable: for any entries that are lost or delayed due to faulty or failed electronic data transmissions; communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines satellites, servers, computers or providers utilised in any aspect of this promotion causing delays or disruption; for entries or claims which are lost, delayed, corrupted, damaged, misdirected or incomplete or cannot be delivered for any technical, delivery or other reason. Proof of posting will not be accepted as proof of receipt.

3.        There is no alternative to the stated Prize or any cash substitute. The Prize is non-exchangeable, non-transferable and non-refundable. The Prize must be accepted as offered and redeemed by the named Winner only. There is no alternative prize, in whole or part (save where the Promoter in its sole discretion deems it reasonably necessary to substitute the Prize for one of greater or equal value).

4.        Winner may be requested to participate in any reasonable publicity when asked by the Promoter and shall not receive payment for such publicity. You may opt-out of publicity. By entering this promotion, entrants agree to be bound by these Terms and Conditions governing this promotion and by any other requirements set out in related promotional materials.

5.        The name and county of the Winner can be obtained by writing Nectar at the address below within 3 months of the promotion close date. If you do not want your surname and county included on the list of winners referred to above, you must notify Nectar within a reasonable period of time before the closing date of the promotion. Without prejudice, Nectar will provide this information to the Advertising Standards Authority on reasonable request.

6.        If you would like a written copy of these Terms and Conditions, please write to Nectar providing your address and contact details.

7.        The Winner participates in the Trip at their own risk and must obtain (and must ensure their Guest obtains) appropriate travel insurance to cover any unforeseen circumstances.

8.        The Winner is fully responsible for the supervision and safety of their Guest, especially if the Guest is under 18. The Promoter and Nectar assume no responsibility for the Guest's welfare or actions during the Trip.

9.        The Promoter and Nectar’s total liability for any claim arising out of or in connection with entering the promotion, the awarding of the Prize, and/or the Trip itself shall not exceed the value of the Prize awarded. This limitation of liability applies to all claims, whether arising in contract, tort (including negligence), or otherwise.

10.      By participating in this promotion, you agree to release, discharge and hold Promoter and the Nectar harmless from any and all injuries, liability, losses and damages of any kind resulting from your participation in this promotion and/or related to your participation in the Trip.

11.      The Promoter and Nectar shall not be liable for any personal injury, loss, or damage suffered by the Winner or their Guest during the Trip, except where such injury, loss, or damage is caused by the Promoter or Nectar’s negligence or wilful misconduct. Nothing in these terms shall limit or exclude the Promoter's or Nectar’s liability for death or personal injury resulting from its negligence. All clauses in these terms are subject to this paragraph 11 of Section 3.

12.      The Promoter and Nectar reserve the right to vary the Terms and Conditions or cancel the draw at any stage in the event of unforeseen circumstances arising beyond its or Nectar’s reasonable control (“Force Majeure Event”). In the event of a Force Majeure Event, neither the Promoter nor Nectar shall be liable for any failure or delay in fulfilling its obligations under these terms.

13.      Any question concerning the legal interpretation of the rules will be based on English law and the Courts of England and Wales will have exclusive jurisdiction.
