Your Nectar Prices Terms & Conditions

Personalised Your Nectar Prices on selected products will be made available to you when you shop instore using the Sainsbury’s SmartShop App or SmartShop handset or online at www.sainsburys.co.uk or using the Sainsbury’s App (“Sainsbury’s online”) and you are a digitally registered Nectar customer. Your Nectar Prices will automatically be applied at checkout.   

  1. Your Nectar Prices are available to United Kingdom Sainsbury’s online shoppers and instore SmartShop shoppers aged 18 and above who have a digitally registered Nectar card. Instore shoppers must register to use SmartShop. Online shoppers must have added Nectar to their Sainsbury’s online account. You can register digitally with Nectar online at www.nectar.com or download and register your card on the Nectar App.  
  2. Your Nectar Prices are not available at concessions or tobacco kiosks, petrol stations, Argos, Habitat or Tu clothing.  
  3. SmartShop is available instore when using the SmartShop App or, where available, SmartShop handsets. To use SmartShop you must register and link your digitally registered Nectar card. You can register for SmartShop at a handset wall instore or on the SmartShop App. To link SmartShop with Nectar, enter your digitally registered Nectar card details when registering.   
  4. To add your Nectar account to your Sainsbury’s online account, log in to your Sainsbury’s online account and go to ‘My Account’ then ‘Nectar card’ and enter your digitally registered Nectar card details. 
  5. Your Nectar Prices are personalised to you based on your shopping habits using your Nectar card. The more you shop and use your Nectar card, the more personalised Your Nectar Prices will become. Where more than one Nectar card is linked to a Nectar account, Your Nectar Prices will be personalised to the shopping activities of the primary Nectar account holder.  
  6. Where household members hold their own digital Nectar and Smartshop registrations they will receive their own Your Nectar Prices offers.   
  7. You will be able to see Your Nectar Prices when logged into your Nectar App, Nectar online (www.nectar.com), Sainsbury’s online account (where your Nectar account is added) or your SmartShop App. View Your Nectar Prices in your Nectar App, SmartShop App or online either before or whilst shopping to see your personalised prices. You can download the Nectar App and SmartShop App at the App Store or at Google Play store. Apple and the Apple logo are trademarks of Apple Inc., registered in the U.S. and other countries. App Store is a service mark of Apple Inc. Google Play and the Google Play logo are trademarks of Google Inc. Your Nectar Prices are not available to view instore or on the SmartShop handsets. 
  8. To get Your Nectar Prices instore, simply scan the item using your SmartShop App or handset. To get Your Nectar Prices online, you need to add your Nectar account to your Sainsbury’s online account and add the item to your basket. For eligible items Your Nectar Price will automatically be applied at checkout.  
  9. Sainsbury’s selects products for inclusion in Your Nectar Prices based on without limitation, shopping preference and legal requirements. Items included in the Your Nectar Prices promotion are selected at our discretion and are subject to change. Your Nectar Prices can be used multiple times within the validity period for each Your Nectar Price. See your Nectar App or Nectar online (www.nectar.com) for validity periods, pricing, product size and any other relevant terms. Occasionally, some Your Nectar Price products may not be available online. There is no cash or other alternative to the stated offers. To receive the Your Nectar Price, you must purchase the exact product shown.   
  10. We reserve the right to withdraw products or change Your Nectar Prices at any time. Your Nectar Prices cannot be applied retrospectively. The Without price shown on Your Nectar Prices is indicative and is based on the selling price in supermarkets on the first day Your Nectar Price is made available. The Without price is subject to change. For example, where you are shown a Your Nectar Prices with a long duration, prices may change for operational reasons. For the most up to date usual selling prices, see Sainsbury’s online (www.sainsburys.co.uk).   
  11. In the event the Without price or Nectar Price is lower than the Your Nectar Price, you will always pay the lowest price.   
  12. For complex promotions (multibuys, meal deals) any products subject to Your Nectar Prices will not show in the basket calculations but will be taken into account when you are charged on the day of delivery and the final calculation will always result in you paying the lowest amount.  
  13. Prices in supermarkets, and local stores may differ, however Your Nectar Prices will not change based on where you shop.   
  14. In the event that there is a service failure on the SmartShop App, the SmartShop handheld device or on Sainsbury’s online which prevents the application of Your Nectar Prices at checkout, we will:  
    1. attempt to notify you in the SmartShop App, on the SmartShop handheld device or on Sainsbury’s online that there is a service failure, and Your Nectar Prices are currently unavailable; and   
    2. after your transaction is complete we will issue you with a Sainsbury’s voucher on your Nectar App within seven (7) days of your transaction for an amount equal to the difference between the amount you paid for your selected Your Nectar Prices products and the amount you would have paid if the Your Nectar Prices had been applied to your transaction. Vouchers can only be used once, within six (6) months or such other date as is notified to you from the date of issue and can only be redeemed by the same shopping method as the original transaction. Instore vouchers can only be redeemed in self-serve or manned checkouts. You cannot redeem vouchers via Mobile Pay or at concessions or currency exchange. Sainsbury’s Digital Nectar Bonus Points Terms & Conditions

Digital Nectar coupons available to primary Nectar account holder only. To use your Digital Nectar coupons you must meet any qualifying conditions. Unless specified, these conditions involve, logging into your account either online at nectar.com or through the ‘Nectar’ App, ‘saving’ the offer to your account, purchasing the promoted product(s) before the expiry date and scanning your Nectar card associated with your account at the time of purchase. Digital Nectar coupons can include, but are not limited to, specific products, product categories or a minimum spend. Digital Nectar coupons are personal to you. The frequency and redemption period of Digital Nectar coupons may vary from time to time. Digital Coupons can only be redeemed once. We can’t guarantee that Nectar offers will always be available. Any qualifying spend doesn’t include spirits and liqueurs, wine (when on buy 6, save 25% promotion), (all alcohol in Scotland and Wales), carrier bags, baby milk products, National lottery tickets, tobacco and related products; gift vouchers or cards; prescriptions or over the counter medicines; travel money; savings or postage stamps; mobile phone cards and vouchers; etop-up, paypoint payments, charity products or car park tickets. And unless stated otherwise on this coupon, this offer cannot be used for purchases of fuel, cashback or saveback, vending machines concessions and restaurants and café shops.

Bonus Nectar Points from Swipe to Win game available in the Nectar App only when a customer is invited to play. Winning is not guaranteed, value of win will vary and be at the discretion of promoter. In order to claim bonus Nectar points, customers who have been invited to play must swipe the screen when prompted. Successful customers bonus Nectar points will be awarded instantly in their Nectar account. Bonus points are non-transferable and there are no cash or free gift alternatives available. Nectar App T&Cs

Please read these terms carefully before using this application ("App"). These terms apply to all uses of this App and by using this App you agree that you have read and accept these terms. If you do not agree to any of these terms, then you must not use the App and must delete the App from your mobile device.

The App is made available to you by Nectar Loyalty Ltd ("Nectar". "us", "we" or "our") who operate the Nectar programme. Nectar Loyalty Ltd is a company registered in England (company number 4224736). Our registered office is at 33 Holborn, London EC1N 2HT. Our VAT registration number is GB877164291. Information we collect
By using this App, you agree that Nectar and the companies participating in Nectar (you can find these listed on nectar.com) may use your information (as defined by the Nectar Privacy Policy) including your geographical location, to better understand your shopping behaviours and to provide you on this App with Nectar points offers and other information on offers, products or services from Nectar and companies participating in Nectar (who will be the only recipients of your information) irrespective of your Nectar Privacy Policy selected data choices.
We collect information about the App's functionality that you access and use. This allows us to identify those areas of the App that are of interest to our customers so that we can refine and continuously improve the App. We also store data such as login details (Nectar card number, surname, postcode or your date of birth), mobile phone number, email address, current Nectar points balance and details of your current Nectar offers so that you can view your offers and points balance when you don't have a network connection, and also to prevent you having to re-enter your login details every time you launch the App. We also collect a unique identifier for your mobile device so that we can link your device to your Nectar account for security purposes.

Points Balance
Your balance today includes any recent activity and your balance from earlier dates too. Points that you have collected in the last few days may not be included here so please check back soon.

Your use of the App
This App is made available for use in connection with your participation in Nectar. You may not use such access or content to generate income of any kind. Any other use of this App and/or materials on this App without our prior written permission is prohibited. In particular, you may not use any data or information made available on or by this App in connection with any business or commercial undertaking (whether or not for profit).

Availability and security of the App
We do not promise full and error free operation of this App at all times. While we try to maintain the security of the App we do not guarantee that the App or the servers or networks used to make the App available will be secure.

Intellectual property
The intellectual property in all design, text, graphics and other material and the selection or arrangement of such material in this App is owned by us and/or our respective licensors.

Our liability to you
We do not make any representations, warranties or terms of any kind in respect of this App or its contents other than those required by law. All information and/or data included in and/or on this App is made available for guidance only. Your use of such information and/or data is therefore entirely at your own risk. We expressly exclude, to the fullest extent permitted by law, all liability of Nectar Loyalty Ltd and its group companies, its directors, employees or other representatives, howsoever arising, for any loss suffered as a result of your use of this App.

This App may include links to websites and/or services owned and/or operated by participating companies and/or third parties. These are provided for your convenience and we are not responsible for and do not give any warranties or make any representations regarding any such websites and/or services and are not responsible for or liable in relation to the content or your use of such websites (other than to the extent required by law).

App Updates
From time to time, we may publish patches or updates to the App to provide you with improved functionality, stability and/or security. If a patch or update is available, you will be able to download the latest version of the App from the appropriate application store.
It is your responsibility to download and install the latest version of the App to your mobile device at all times.

Waiver and severance
Any failure or delay by us in exercising any right or remedy under these terms will not constitute a waiver of that right or remedy and we may still enforce that right or remedy at a later time.
If any provision of these terms is held to be invalid or unenforceable by any court or authority of competent jurisdiction, that provision shall be severed from the remainder of the terms which will remain in full force and effect.

Assignment
You agree that we may assign any or all of our rights and/or novate, transfer, sub-contract or delegate any or all of our obligations under these terms to any third party.
Your use of the App and these terms are personal to you and are agreed to by you for your own benefit and not for the benefit of any other person. You may not assign or otherwise transfer these terms to any other person without our prior written permission, which we will not unreasonably withhold.

Variations to these terms
As part of the constant evolution of the App, we may amend these terms or the way in which we provide the App at any time.
When we make any such changes, we shall take reasonable steps to make you aware of them by, for example, providing notice to you through the App. If you do not agree to the amended terms, then you must cease use the App.

Termination and Enforcement
You acknowledge that, in addition to any rights that we have, any breach of these terms will entitle us to terminate your use of the App immediately and without notice.
We reserve the right to change, suspend, cease or terminate the App (or any part of it) at any time if we consider this necessary for legal, business or operational reasons.

Entire Agreement
These terms (including the Nectar Privacy Policy) constitute the whole agreement between you and us relating to the App and supersede any prior written or oral promises of any nature that may have been made about the App. Neither you nor we have entered into these terms in reliance on any prior representation or statement (whether made innocently or negligently) that is not set out in these terms.

Governing Law
These terms will be governed by English law and the courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these terms.
