Can I use my phone as a Nectar card by swiping it in store?

Unfortunately, due to some technical limitations, not all Nectar partners can scan phones. So don't forget to hand over your Nectar card or key tag at the check out!

How does the app get updated?

Should there be an update to the app, there will be a notification in the App Store and Google Play.

How do I remove the app?

You can uninstall it just like any other app. Don't worry, there will still be some great offers waiting for you, should you download the app again.

Do I need an internet connection to access all the functions?

You don't need an internet connection to use the app, although you will need to connect to get your latest offers.

How do I log in to the app?

You will need to enter the last 11 digits of your Nectar card number and your online password.

Once I accept an offer, how long will it be valid for?

Your opt-in to the offer will be valid for as long as the offer is valid.

How do I provide feedback for the app or suggestions to improve it?

Please read these terms carefully before using this application ("App"). These terms apply to all uses of this App and by using this App you agree that you have read and accept these terms. If you do not agree to any of these terms, then you must not use the App and must delete the App from your mobile device.

The App is made available to you by Nectar Loyalty Ltd ("Nectar". "us", "we" or "our") who operate the Nectar programme. Nectar Loyalty Ltd is a company registered in England (company number 4224736). Our registered office is at 33 Holborn, London EC1N 2HT. Our VAT registration number is GB877164291. Information we collect
By using this App, you agree that Nectar and the companies participating in Nectar (you can find these listed on nectar.com) may use your information (as defined by the Nectar Privacy Policy) including your geographical location, to better understand your shopping behaviours and to provide you on this App with Nectar points offers and other information on offers, products or services from Nectar and companies participating in Nectar (who will be the only recipients of your information) irrespective of your Nectar Privacy Policy selected data choices.
We collect information about the App's functionality that you access and use. This allows us to identify those areas of the App that are of interest to our customers so that we can refine and continuously improve the App. We also store data such as login details (Nectar card number, surname, postcode or your date of birth), mobile phone number, email address, current Nectar points balance and details of your current Nectar offers so that you can view your offers and points balance when you don't have a network connection, and also to prevent you having to re-enter your login details every time you launch the App. We also collect a unique identifier for your mobile device so that we can link your device to your Nectar account for security purposes.

Points Balance
Your balance today includes any recent activity and your balance from earlier dates too. Points that you have collected in the last few days may not be included here so please check back soon.

Your use of the App
This App is made available for use in connection with your participation in Nectar. You may not use such access or content to generate income of any kind. Any other use of this App and/or materials on this App without our prior written permission is prohibited. In particular, you may not use any data or information made available on or by this App in connection with any business or commercial undertaking (whether or not for profit).

Availability and security of the App
We do not promise full and error free operation of this App at all times. While we try to maintain the security of the App we do not guarantee that the App or the servers or networks used to make the App available will be secure.

Intellectual property
The intellectual property in all design, text, graphics and other material and the selection or arrangement of such material in this App is owned by us and/or our respective licensors.

Our liability to you
We do not make any representations, warranties or terms of any kind in respect of this App or its contents other than those required by law. All information and/or data included in and/or on this App is made available for guidance only. Your use of such information and/or data is therefore entirely at your own risk. We expressly exclude, to the fullest extent permitted by law, all liability of Nectar Loyalty Ltd and its group companies, its directors, employees or other representatives, howsoever arising, for any loss suffered as a result of your use of this App.

App Updates
From time to time, we may publish patches or updates to the App to provide you with improved functionality, stability and/or security. If a patch or update is available, you will be able to download the latest version of the App from the appropriate application store.
It is your responsibility to download and install the latest version of the App to your mobile device at all times.

Waiver and severance
Any failure or delay by us in exercising any right or remedy under these terms will not constitute a waiver of that right or remedy and we may still enforce that right or remedy at a later time.
If any provision of these terms is held to be invalid or unenforceable by any court or authority of competent jurisdiction, that provision shall be severed from the remainder of the terms which will remain in full force and effect.

You agree that we may assign any or all of our rights and/or novate, transfer, sub-contract or delegate any or all of our obligations under these terms to any third party.
Your use of the App and these terms are personal to you and are agreed to by you for your own benefit and not for the benefit of any other person. You may not assign or otherwise transfer these terms to any other person without our prior written permission, which we will not unreasonably withhold.

Variations to these terms
As part of the constant evolution of the App, we may amend these terms or the way in which we provide the App at any time.
When we make any such changes, we shall take reasonable steps to make you aware of them by, for example, providing notice to you through the App. If you do not agree to the amended terms, then you must cease use the App.

Termination and Enforcement
You acknowledge that, in addition to any rights that we have, any breach of these terms will entitle us to terminate your use of the App immediately and without notice.
We reserve the right to change, suspend, cease or terminate the App (or any part of it) at any time if we consider this necessary for legal, business or operational reasons.

Entire Agreement
These terms (including the Nectar Privacy Policy) constitute the whole agreement between you and us relating to the App and supersede any prior written or oral promises of any nature that may have been made about the App. Neither you nor we have entered into these terms in reliance on any prior representation or statement (whether made innocently or negligently) that is not set out in these terms.

Governing Law
These terms will be governed by English law and the courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these terms.
